NYU/AFSC: Immigration Incarceration-The Expansion and Failed Reform of Immigration Detention in Essex County, NJ

“Every indicator of the conditions and treatment of immigrant detainees in Essex County shows a detention system that is failing to meet the bare minimum of humane treatment and due process. What’s more, the increase in the number of immigrants detained and the conditions of their detention are contrary to promises for reform and prosecutorial discretion at the national level, as well as assurances of oversight at the local level.”

National Immigration Law Center: Deportation Without Due Process

“Authors procured the previously unreleased documents, which included emails, memos, and data, through a Freedom of Information Act (FOIA) lawsuit. According to the report, the documents revealed evidence that agents involved with the program routinely provided inaccurate and misleading information to detainees in deportation proceedings to coerce them into signing “stipulated orders of removal.” Such an order waives a noncitizen’s right to a day in court in exchange for speedy deportation.”

“Immigrant advocates nationwide continue to report widespread due process and human rights violations, including the overreliance on incarceration, mistreatment by guards, denial of access to legal service providers, inadequate medical care, misuse of solitary confinement, and discrimination against sexual minorities. These violations demonstrate that the commitment to reform made by ICE leadership has yet to have any substantive impact on the ground.”

“In recent years, the United States has witnessed a dramatic increase in the number of noncitizens held in immigration detention. This rapidly increasing population has drawn attention to the poor conditions of the nation’s immigration detention facilities and the barriers immigrant detainees face in seeking representation of counsel in removal proceedings. These problems raise a variety of constitutional and policy concerns.”
